Language is central to political philosophy, yet until now there has been little in the way of a common framework capable of bridging disciplines that share an interest in language, power, and ethics. Much liberal theorizing of the past twenty years has been built around a conception of neutrality and an accompanying virtue of reasonableness according to which citizens ought to be able to view public policy debates from a perspective detached from their comprehensive conceptions of the good. The view of “justifi catory neutrality” that emerges from this view is discussed and rejected as embodying controversial views about the relationship of individuals to their conceptions of the good. It is shown to be (...) based upon a “protestant” assumption according to which conceptions of the good can be cashed out in terms of propositional beliefs. An alternative conception of reasonableness, grounded in the stable disposition of individuals to prefer social peace over conflict is described. It is argued that it better satisfies the neutralist requirement than do theories of justifi catory neutrality. (shrink)

Talk of harm reduction has expanded horizontally, to apply to an ever-widening range of policy domains, and vertically, becoming part of official legal and political discourse. This expansion calls for philosophical theorization. What is the best way in which to characterize harm reduction? Does it represent a distinctive ethical position? How is it best morally justified, and what are its moral limits? I distinguish two varieties of harm reduction. One of them, technocratic harm reduction, is premised on the fact of (...) non-enforceability of prohibitionist policies. The second, deliberative harm reduction, is premised on the fact of reasonable disagreement, grounded in the fact that reasonable persons disagree about a range of controversial behaviours. I argue that deliberative harm reduction better accounts for some of harm reduction’s most attractive features, and provides a plausible way of accounting for harm reductions’s justificatory grounds and limits. I outline Rawls's theory of justification, highlighting its philosophical and pragmatic conditions. I argue that the theory has remained essentially unchanged since his earliest methodological writings, and that his recent writings have sought to show how "justice as fairness" can satisfy these conditions, given Rawls's new construal of the "fact of pluralism" which theories of justice designed for modern Western liberal democracies must address. I argue that neither Rawls's revised conception of reflective equilibrium, based on the "fixed points" of such (...) societies' political cultures rather than on individuals' "considered moral judgments" nor the newer notion of "overlapping consensus", succeed in justifying "justice as fairness" according to the terms of Rawls's theory of justification. Many of the problems that would be faced in setting up transnational institutions mirror problems that have already been addressed by appropriate institutional mechanisms in the establishment of the modern nation-state.

ABSTRACT Recent writings by philosophers such as David Miller and Yael Tamir have undertaken to provide nationalism with a normative foundation, a task which has been all but ignored by post‐War English‐language political philosophy. I identify and criticise three lines of argument which have been deployed in their writings. First, it is argued by Miller that the universalism and abstraction of rationalist moral theories have made them suspicious of ‘particularisms’ such as nationalism, but that they stem from a faulty metaethics. (...) Against this I argue that abstraction and universality need not be grounded in a universalist metaethics, but can be derived pragmatically from the ethical needs of multicultural societies. Second, it is argued that liberal policies such as taxation and material redistribution, restrictions on immigration, as well as liberal concepts such as political obligation, presuppose the validity of the nationalist point of view. Against this I hold that nationalism never provides the strongest moral grounds for these policies and concepts, and that, in the specific case of distributive justice, it can even undermine them. And third, I examine the argument that the historical excesses of which nationalists have been guilty are actually the product of a narrow, ‘ethnic’nationalism, in contrast to which we can articulate a categorically distinct, open, ‘civic’nationalism, which would be broadly compatible with liberal political morality. I argue that the concept of civic nationalism is unstable, and that under fairly plausible and widespread empirical conditions, it either collapses back into a form of ethnic nationalism, or else becomes devoid of any recognisably nationalist content. My intention in this essay will be to explore the role that consent-based arguments perform in Kant's political and legal philosophy. I want to uncover the extent to which Kant considered that the legitimacy of the State and of its laws depends upon the outcome of intersubjective deliberation. Commentators have divided over the following question: Is Kant best viewed as a member of the social contract tradition, according to which the legitimacy of the state and of the laws it promulgates (...) derives from the consent of those people over whom it claims authority, or should he be read as having put forward a secularized version of natural law theory, according to which the state and its laws are legitimate to the extent that they are attained by standards of sound reason and supported by an objective account of the human good? Multicultural theory and practice have in recent years been subjected to substantial criticism. While some of these criticisms can be dismissed as grounded in discriminatory attitudes, others are less easily swept aside, as they are underwritten by values that multiculturalists tend to affirm. A harm reduction approach, that recognizes that reasonable citizens can disagree about some multicultural practices while at the same time acknowledging that attempts at prohibition are either exceedingly costly or contrary to the very values that opponents subscribe (...) to, can provide an alternative foundation for some multicultural accommodations to which both opponents and advocates can subscribe. It involved permitting contested behaviours while imposing regulations aimed at minimizing the harms relative to shared values that they can give rise to. (shrink)

Defining the principles of justice that ought to govern the global economic and political sphere is one of the most urgent tasks that contemporary political philosophers face. But they must also contribute to working through the institutional implications of these principles. How might principles of global justice be realized? Must the institutions that aim to implement them be transnational, or can global justice be attained within the context of the state system? Can institutions of democratic self-governance be imagined beyond the (...) nation-state? These are just some of the questions that still face political philosophers even when issues of abstract principle have been addressed. This volume establishes a dialogue between philosophers working at all levels of abstraction. Some of the authors are concerned with the grounds and scope of the obligations that bind the citizens and governments of rich countries to those of poorer nations. But many examine the question of how these obligations can be satisfied, both within existing institutional frameworks and beyond. The publication of "The Practice of Liberal Pluralism" by Willam Galston has appeared as an event of first importance regarding contemporary theory about the relation between pluralism and liberalism. William Galston’s theory has had a visible evolution: in "Liberal Purposes", the main object is a critique of neutralism and a defence of perfectionist liberalism, whereas "Liberal Pluralism" main concern was to draw the limits of state intervention. This evolution is the object of numerous questions in the following discussion. "The Practice (...) of Liberal Pluralism" operates an interesting synthesis on this point. Galston defines himself as a liberal pluralist such as Berlin, but although he acknowledges that conflict between values can be tragic, he minimizes this aspect in the following discussions, and considers the possibility of having prima facie duties. One of the main arguments for the defence of value pluralism is its capacity to explain the complexity of the moral universe. Galston endorses a political pluralism, which means that the sources of authority are multiple. Galston’s liberalism is very tolerant regarding non-liberal communitarian practices, although this tolerance is based on the defence of an exit right, which is a fundamental notion in his theory. In the following discussion, Galston proposes how to understand this right of exit in an adequate manner. (shrink)

Mark Kingwell’s A Civil Tongue is a particularly striking example of this recent trend. Kingwell argues that, for diverse societies, justice reduces to vigorous public debate governed by the conversational virtue of civility, or politeness. According to Kingwell, “Whatever passes through a set of conversational constraints can be expected to be the valid norms or principles of justice”.

One of the most prominent themes of recent political philosophy, at least in the English-speaking world, has been the challenge which the cultural and moral diversity of modern Western societies poses for traditional liberal theories of justice. Given that these theories, in their classical formulations, either ignored the issue of social heterogeneity, or operated on the tacit assumption that the societies to which they would be applied were essentially homogeneous, what changes should a new appreciation of diversity impose upon both (...) the content and the pattern of justification of theories of justice? Philosophers have been far from unanimous in their answers to this basic question. Some, like Will Kymlicka, have argued that recognizably liberal, autonomy-based justificatory arguments should lead us to change our view of liberalism's content, in that it should now incorporate collective rights to the traditional repertoire of individual rights. Others, like Iris Young, have argued that a real recognition of “difference” should lead to the wholesale abandonment of the liberal framework. Still others have argued that it is the manner in which liberalism goes about justifying normative principles that ought to be rethought, given the “fact of pluralism.” The disagreements on moral and political issues which are constitutive of modern societies have led some to argue that we can no longer hope to justify substantive principles deductively on the basis of general moral propositions taken as axiomatic. Authors who follow this line have argued that, in order not to tread on the moral or cultural toes of a diverse citizenry, liberal justification must ultimately reduce to the outcome of certain deliberative procedures. In radically plural societies, justified norms of social interactions are those to which people in conversation with one another would agree. (shrink)

In Isaiah Berlin, John Gray interprets Berlin as having made value pluralism the basis of an anti‐rationalist, “agonistic” liberalism. Gray argues that Berlin's value pluralism actually stands in tension with his liberalism, and that a whole‐hearted affirmation of value pluralism should have led him to reject the claim that liberal institutions are morally superior. But Berlin's pluralism is more moderate than that ascribed to him by Gray, in that it does not allow for diminishing the value of liberty beyond a (...) certain point. This version of pluralism is more compatible with the objectivity Gray claims for pluralism than is his own version. (shrink)
